La disciplina dei contratti pubblici tra persistenze e spinte all’innovazione

The essay analyses the general features of the Code of Public Contracts approved in 2016 (Legislative Decree no. 50 of 18 April 2016), which was significantly amended in 2019 (Law no. 55 of 14 June 2019). In particular, it deals with the historical origins of the discipline and dwells on the differences in approach between national law and European directives approved until the most recent ones in 2014 (n. 23,24 and 25 of 2014). While national law favours precise rules that strictly bind public administrations, also for the purposes of combating corruption, European law is more in favour of giving them room for discretion.
